In accordance with Strategy 6 SME 2020 and the OSH (Amendment) Act 2022, each SME company in Malaysia must appoint a Trained Person as an Occupational Safety and Health (OSH) Coordinator. OSH Coordinator Requirements Under the OSH (Amendment) Act 2022
According to Section 29A of the OSH (Amendment) Act 2022:
- Subsection (1): Any employer with five or more employees must appoint one of their employees as an OSH Coordinator if their workplace is not included in any class or description of place of work published in the Gazette.
- Subsection (4): Employers who fail to comply with this requirement can face penalties, including fines of up to RM50,000 or imprisonment for up to six months, or both.
